Welcome to Fallen Gate. These Terms of Service ("Terms") govern your access to and use of fallengate.com (the "Website"), purchases of our products, and participation in services offered by Fallen Gate ("we," "us," or "our").
By using our Website or placing an order, you agree to these Terms and our applicable policies. Any recurring membership enrollment is additionally governed by the separate Fallen Gate VIP Club Membership Terms and requires express, informed consent.
You agree to provide accurate, complete, and current information when placing orders or creating an account.
You may not use our Website for fraudulent, unlawful, or unauthorized purposes, interfere with its operation, or violate applicable laws.
Customers enrolling in recurring paid membership services must be at least 18 years old or otherwise legally authorized to enter into the applicable agreement.
Fallen Gate offers clothing, accessories, and related merchandise.
We make reasonable efforts to accurately display product descriptions, pricing, colors, sizing, and availability. Minor variations may occur because of manufacturing differences, lighting, or display settings.
We reserve the right to correct errors, update product information, and limit quantities when reasonably necessary.
If an order cannot be fulfilled, we will notify the customer and provide an appropriate refund or resolution.
Product prices are displayed at checkout in the applicable currency. Shipping charges, taxes, and any other applicable fees will be disclosed before purchase.
By placing an order, you authorize payment for the merchandise and applicable charges shown in your order summary.
Any recurring VIP Club membership payment requires separate disclosure and express authorization. Authorization for a one-time merchandise purchase alone does not constitute authorization for recurring membership charges.
We use third-party payment processors to securely process transactions.
Shipping availability, estimated delivery times, and shipping costs are displayed on our Website or during checkout.
Delivery estimates may vary based on destination, carrier operations, customs processing, and other circumstances.
Customers are responsible for providing accurate shipping information. If a delivery issue occurs, our support team will assist in reviewing available resolution options.
Nothing in these Terms limits mandatory consumer rights relating to delivery, lost merchandise, or incorrectly fulfilled orders.
Eligible merchandise may be returned within 60 days of delivery, subject to our Refund Policy.
Returned items must be unworn, unwashed, and in their original condition with applicable tags attached.
Exchanges are subject to availability. Return shipping costs and other conditions are explained in our Refund Policy.
Merchandise refunds and VIP Club membership billing are governed by separate policies. Returning merchandise does not automatically cancel an independently authorized VIP Club membership.

Beginning October 29, 2026, Fallen Gate offers an optional recurring membership service known as Fallen Gate VIP Club.
The membership may be offered to eligible customers purchasing through our Website.
Orders placed before October 29, 2026, are not automatically enrolled in VIP Club and are not subject to new VIP Club membership charges solely because of these updated Terms.
Orders made through third-party marketplaces or other external sales channels do not automatically create VIP Club memberships.
Participation requires separate, affirmative acceptance of the membership's recurring payment terms.
Eligible new members receive a 28-day free trial beginning on their confirmed enrollment date.
No membership fee is charged during the free trial.
Unless canceled before the first scheduled payment, membership automatically converts into a paid recurring subscription.
After the free trial, the recurring fee is 29.99 USD every , as disclosed and expressly accepted during enrollment.
The first payment is scheduled 28 days after enrollment. Subsequent payments follow the disclosed billing schedule until cancellation.
Membership charges are separate from merchandise charges and do not require additional merchandise purchases.
VIP Club provides access to the benefits expressly described in the membership offer, which may include member-exclusive offers, selected promotional pricing, and early access to eligible products.
Specific benefits, eligibility requirements, and applicable restrictions will be disclosed to customers.
VIP Club automatically renews unless canceled.
Members may cancel at any time through our online cancellation method, by email, by telephone, or by text message.

Cancellation before the trial expires prevents the first membership charge.
There is no membership cancellation penalty.

Fallen Gate may update VIP Club benefits or membership pricing from time to time.
We will provide applicable advance notice of material changes and obtain additional affirmative consent where required by law.
Price changes will not be applied retroactively to completed billing periods.
Members retain the right to cancel in accordance with applicable law.
Promotional offers may be subject to eligibility requirements, expiration dates, product exclusions, or other clearly disclosed conditions.
Discounts may not be combined unless expressly permitted.
VIP-exclusive promotions apply only to eligible participating members and products.
You are responsible for maintaining the confidentiality of your account credentials and notifying us of suspected unauthorized access.
We may suspend access when reasonably necessary to address fraud, security threats, or violations of these Terms.
Such action does not eliminate any applicable refund or cancellation rights.
The Fallen Gate name, branding, original website content, photographs, designs, and other protected materials are owned by Fallen Gate or used under applicable rights or licenses.
You may not reproduce, distribute, or commercially exploit protected materials without authorization.
Our collection and use of personal information are described in our Privacy Policy.
Information used to administer VIP Club may include membership status, billing schedules, payment authorization records, and cancellation requests.

Fallen Gate may offer promotional SMS communications to customers who separately consent to receive them.
Consent to marketing messages is not a condition of purchasing merchandise or enrolling in VIP Club.
Message frequency varies. Message and data rates may apply. Marketing subscribers may opt out by replying STOP to the sending number and may request assistance by replying HELP, where supported.
Transactional communications relating to purchases, membership billing, and cancellation may be sent as permitted by applicable law.
Separate mobile messaging terms apply to our promotional SMS program.
Products and Website services are provided subject to applicable consumer protection laws.
To the maximum extent permitted by law, Fallen Gate is not responsible for indirect or consequential losses caused by circumstances beyond its reasonable control.
Nothing in these Terms excludes or restricts rights, warranties, remedies, or liabilities that cannot lawfully be excluded.
We may update these Terms to reflect changes in our services, business practices, or legal obligations.
Updated Terms will be posted with a revised effective date. Where required, we will provide additional notice or obtain affirmative acceptance.
Updated Terms do not retroactively authorize recurring charges for orders placed before the VIP Club launch or for customers who have not consented to membership enrollment.
